Patna High Court

Manoj Mahto @ Manoj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted subject to a bond of Rs.30,000 and conditions under Section 480(3) of the BNSS, 2023.

Summary

Manoj Mahto was arrested on 4 July 2023 in connection with a case registered under IPC sections 363 and 34, later amended to include sections 302, 201 and 120(B). He had been in custody for over two years and his bail applications had been rejected twice earlier. The prosecution had examined eight witnesses, and a Section 311 Cr.P.C. application for summoning an additional witness caused further delay. The petitioner argued that the trial was at a standstill, he had a clean record, and continued detention was unnecessary. The court, considering the stage of the trial, the delay, and the pending Section 311 application, granted regular bail on a bond of Rs.30,000 subject to conditions under Section 480(3) of the BNSS, 2023.

Issues considered

  • Whether bail should be granted to the accused despite the seriousness of the offences and the stage of the trial.
  • Whether the delay caused by the Section 311 application justifies bail.
