Patna High Court

Pravin Kumar @ Parvin Kumar @ Pranav KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The petition for anticipatory bail was dismissed as the petitioner was not entitled to such relief.

Summary

The petitioner, Pravin Kumar, was accused of making telephonic demands for Rs. 2 lakh and a bullet bike from the deceased Naina Kumari, allegedly constituting dowry harassment under Sections 3 and 4 of the Dowry Prohibition Act. The brother of the deceased testified that the calls prompted Naina Kumari to commit suicide by hanging, leading to an FIR charging the petitioner under Section 306 of the Indian Penal Code. The petitioner filed an anticipatory bail application, fearing arrest in the case. The High Court examined whether the allegations amounted to a cognizable offence and whether the petitioner was entitled to bail before any arrest. The Court found the allegations serious, involving a suicide linked to dowry demand, and concluded that the petitioner did not merit the protection of anticipatory bail. Consequently, the petition for anticipatory bail was rejected.
