Holding

The court held that anticipatory bail could not be granted due to the gravity of the offences.

Summary

The petitioner, Kunal Jha, sought anticipatory bail fearing arrest in a case (Chewara P.S. Case No. 13 of 2024) involving alleged purchase of looted goods under IPC sections 341, 342, 356 and 379. The prosecution alleged that four unknown persons committed the loot and that the petitioner bought the stolen items. The petitioner’s counsel contended his innocence and denied any involvement. The court examined the seriousness of the offences and, considering the gravity, declined to grant anticipatory bail. The petition was ordered to surrender to the lower court within two weeks and to apply for regular bail, failing which the police were directed to arrest him.
