Patna High Court

Kanhaiya DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail may be granted to the petitioners subject to the conditions stipulated under Section 438(2) CrPC and Section 482(2) B.N.S.S.

Summary

The petitioners, Kanhaiya Das and Rajesh Paswan, ward secretaries, were implicated in an FIR under Sections 409 and 34 of the IPC for alleged misappropriation of funds allocated under the Chief Minister’s Seven Nischaya Yojana. They argued that the work had been completed despite COVID‑19 related delays and submitted a joint enquiry report to support this claim. The State opposed their request for anticipatory bail. The High Court considered the completion of the work and the petitioners’ willingness to surrender within eight weeks, and ordered that they be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the B.N.S.S. The order effectively granted anticipatory bail with specified safeguards.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 of the Criminal Procedure Code in view of the alleged offences under Sections 409 and 34 of the IPC.
  • Whether the completion of the scheme work and the pandemic‑related delays justify the grant of bail.
