Holding

The court denied bail to the petitioner.

Summary

The petitioner, Md. Aman, was arrested in connection with a robbery on a train where money and a mobile phone were stolen from an informant’s wife, who subsequently fell from the train and died. He is charged under Section 305(b) and Section 105 of the Bihar Negotiable Instruments Act. The prosecution’s case relies on a self‑inculpatory statement of a co‑accused and the petitioner’s four prior criminal convictions. The petitioner applied for regular bail after being in custody since 28‑04‑2025. The court, noting the seriousness of the offence, the death of the victim, the self‑inculpatory statement and the petitioner’s antecedents, declined to grant bail and dismissed the application.

Issues considered

  • Whether regular bail should be granted to the petitioner given the nature of the offence and the death of the victim
  • Whether the petitioner’s prior criminal record and the self‑inculpatory statement of a co‑accused justify denial of bail
