Patna High Court

Rakesh kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no sufficient material to justify continued detention.

Summary

Rakesh Kumar was arrested in connection with a murder case (PS Case No. 22 of 2025) under Section 103(1)/3(5) of the BNS and Section 27 of the Arms Act, although his name does not appear in the FIR. He has been in custody since 21‑08‑2025. The prosecution’s case against him rests solely on a confessional statement of co‑accused Jai Prakash Mahto, and no other incriminating material was found during the investigation, which has already been completed and a charge‑sheet filed. The petitioner, a man of clean antecedents, pleaded for bail, arguing that there is no risk of tampering with evidence. The court, noting the lack of substantive evidence and the completed investigation, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 480(3) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to bail despite the confessional statement of a co‑accused linking him to the offence
  • Whether the completed investigation and absence of incriminating material justify granting bail
