Vikram Yadav @ Vikram KumarversusThe State of Bihar

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to the conditions prescribed under Section 438(2) of the CrPC and Section 482 of the B.N.S.

Summary

Vikram Yadav applied for anticipatory bail after being implicated in a case (PS No. 106 of 2025) alleging firing on an informant under several sections of the B.N.S. and the Arms Act. The petitioner claimed innocence, asserting that the injury to the informant was caused by a blunt object and that he has a clean antecedent. The State opposed the bail, arguing the seriousness of the offences. The court examined the allegations and, considering the petitioner's claim of false implication and lack of prior record, granted anticipatory bail subject to conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S. The bail bond was set at Rs. 10,000 with two sureties, to be surrendered if arrested within four weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the allegations under the B.N.S. and Arms Act.
  • Whether the petitioner's claim of innocence and clean antecedent justify the grant of bail despite the seriousness of the offences.
