Holding
The court allowed the application for regular bail, confirming the provisional bail previously granted.
Summary
The petitioner, Govind Kumar, was arrested in connection with a kidnapping case (PS Mehdiganj Case No. 80/2022) under Sections 363, 365 and 366(A) of the Indian Penal Code. He applied for regular bail, contending that he was falsely implicated and that the victim’s statement indicated she had eloped with him. The prosecution opposed the bail, while the petitioner’s counsel highlighted his clean antecedents and the provisional bail already granted on 03‑12‑2025. The court examined the victim’s statement and found it sufficient to raise doubt about the kidnapping allegation. Consequently, the court confirmed the provisional bail by granting regular bail on the same conditions. The petitioner was ordered to remain on the existing bail bonds.
Issues considered
- Whether the petitioner is entitled to regular bail despite the serious nature of the offences under Sections 363, 365 and 366(A) IPC.
- Whether the victim’s statement indicating elopement creates reasonable doubt warranting bail.
