Holding
Anticipatory bail was denied as the petitioner failed to provide fresh grounds for reconsideration.
Summary
The petitioner, Amardeep Kumar, filed an anticipatory bail petition in 2026, having previously been denied anticipatory bail on 28 November 2022 in the same matter. The petitioner offered no new material or cogent reasons to justify reconsideration of the earlier order, despite a four‑year gap and multiple similar charges against him. The learned counsel for the State opposed the petition, and the court noted the lack of fresh grounds for granting bail. The judge observed that the petitioner does not merit the privilege of anticipatory bail under the circumstances. Consequently, the court rejected the anticipatory bail petition.
Issues considered
- Whether anticipatory bail can be granted when the petitioner offers no new material or reasons after a prior refusal.
Subjects
