Bail was denied because arms and ammunition were recovered from the petitioner’s house and he has prior criminal antecedents.

Summary

The petitioner, Vishvjit Kumar, applied for bail after being in custody since 7 June 2025 in connection with a case involving alleged possession of arms and ammunition. He is charged under Sections 132, 109, 186, 317(5) and 3(5) of the Bihar Narcotic Substances Act, 2023 and Sections 25(1‑A), 25(1‑B)(a), 26, 27 and 35 of the Arms Act, 1959. The prosecution presented a seizure list showing multiple loaded INSAS rifle magazines and live rounds recovered from the petitioner’s house, and highlighted five prior criminal antecedents. The petitioner claimed innocence and alleged that the FIR was fabricated. The Court, after considering the seriousness of the arms recovery and the petitioner’s antecedents, declined to grant bail. Consequently, the petition for bail was refused.

Issues considered

  • Whether bail should be granted to the petitioner despite the recovery of arms and ammunition from his residence.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
  • Whether the nature of the offences under the BNS Act, 2023 and the Arms Act, 1959 warrants refusal of bail.
