The court granted provisional bail to the petitioner subject to strict monetary and conduct conditions.
Summary
The petitioner, Bhawesh Sah, faced arrest in a cheating case (Case No. 295 of 2025) alleging he defrauded Rs. 11 lakh from the second opposite party. He had returned Rs. 3 lakh and offered to repay the remaining amount in monthly installments until January 2027. Relying on a mediation report, his counsel sought provisional bail, proposing a bail bond of Rs. 10,000 with two sureties and a schedule of installment deposits to the court. The court, applying Section 438(2) of the CrPC and Section 482 of the Bihar Negotiable Instruments Act, granted provisional bail conditioned on the payment of the first installment and compliance with the monthly payment plan, with cancellation for default. The order also warned that any threat to the opposite party would invite police action, and indicated that full repayment could lead to confirmation of bail.
Issues considered
- Whether the petitioner is entitled to provisional bail despite charges of cheating under sections 316, 318, 351, and 352 of the Bihar Negotiable Instruments Act.
- Whether the conditions imposed under Section 438(2) CrPC and Section 482 BNIA are appropriate.
- Whether alleged threats to the opposite party affect the grant of bail.
