Patna High Court

Rampukar Singh @ Ram Pukar Singh @ Rampukar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to strict conditions.

Summary

Rampukar Singh, accused of demanding rangdari at gunpoint and firing on the informant's son under several IPC sections and the Arms Act, has been in custody since 16 May 2024. He filed a bail petition claiming the FIR allegations are false and fabricated. The State opposed bail, highlighting the specific charge of firing and the petitioner’s other pending cases, though he is on bail in those. The court considered the length of pre‑trial detention and the petitioner's claim of falsity, and ordered his release on bail with a Rs 10,000 bond and two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be implemented without delay for verification.

Issues considered

  • Whether bail should be granted despite serious charges of firing and extortion under the IPC and Arms Act
  • Whether the alleged falsity of the FIR impacts the grant of bail
  • Whether the petitioner’s other pending cases affect his eligibility for bail
