Patna High Court

Horil PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed regular bail to the petitioner.

Summary

The petitioner, Horil Paswan, was charged under IPC sections 147, 148, 149, 324, 307, 504 and Section 27 of the Arms Act for allegedly firing on the victim. He had been in custody since 25 April 2025 and his earlier bail application was dismissed as withdrawn. He pleaded innocence and argued that, since charges had been framed, he was entitled to regular bail. The State opposed the bail. The Patna High Court, noting the petitioner’s clean antecedent, the framing of charges, and the period of custody, allowed the regular bail, directing a bond of Rs 10,000 with two sureties and imposing conditions of cooperation in the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail after charges have been framed for offences under the IPC and Arms Act
  • Whether the seriousness of the offences and the period of custody justify denial of bail
