Patna High Court

Banty Kumar @ Banti KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Banty Kumar was arrested in connection with a viral video threatening revenge for a double murder, and charged under Sections 353, 196, 197 and 61(2) of the Bharatiya Nyaya Sanhita, 2023. He pleaded innocence, arguing that he had no overt act and possessed a clean criminal record, while the co‑accused had already been released on bail. The State opposed bail, contending his participation in the video warranted continued detention. The Court examined the lack of specific overt act against the petitioner and his long custody since July 2025, and consequently ordered his release on bail with a bond of Rs. 10,000 and two sureties, imposing conditions regarding attendance, verification of antecedents, and possible cancellation. The order clarified that any observations made would not affect the trial.

Issues considered

  • What is the appropriateness of granting bail to the petitioner given the alleged participation in a viral threat video and the charges under the Bharatiya Nyaya Sanhita?
  • Does the absence of a specific overt act and the petitioner's clean antecedent justify bail despite the seriousness of the offences?
