Ranjeet Yadav @ Ranjeet Kumar Yadav @ Ranjit Yadav @ Ranjeet KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Ranjeet Yadav, was arrested in connection with a case registered under Section 137(2) and Section 96 of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the POCSO Act for allegedly taking away a minor girl for the purpose of marriage. He pleaded innocence, claimed a clean antecedent and had been in custody since 16‑06‑2025. The State opposed bail, while the petitioner’s counsel argued that the victim’s statement indicated a consensual relationship. The Court, after reviewing the victim’s statement and the circumstances, held that the petitioner was eligible for regular bail. Accordingly, the Court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, emphasizing that the observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under B.N.S. 2023 sections 137(2) and 96 and POCSO Act sections 8 and 12.
  • Whether the victim’s statement indicating a relationship influences the bail decision.
  • Whether the bail conditions imposed are appropriate under the law.
