The court granted anticipatory bail to the petitioner, subject to a bail bond, two sureties and a condition to deposit Rs 4,000 per month to the complainant.

Summary

The petitioner Sujit Kumar applied for anticipatory bail in connection with Complaint No.317 of 2023, which alleged dowry harassment under Section 498A of the Indian Penal Code. He asserted that he had not committed any offence and, to preserve family harmony, offered to pay Rs 4,000 per month to the complainant. The complainant, facing severe financial hardship, accepted this offer. After hearing counsel for both parties and the Additional Public Prosecutor, the court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties and to deposit Rs 4,000 monthly in the complainant’s bank account, invoking Section 438(2) of the Code of Criminal Procedure. The bail is to be effective if the petitioner is arrested or surrenders within six weeks from the order. Consequently, the petition for anticipatory bail was allowed with conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Section 498A IPC.
  • Whether imposing a monthly payment to the complainant is a permissible condition for anticipatory bail.
