The Court granted bail to the petitioner.

Summary

Munfed Khan applied for bail in a cyber‑crime case (Chhapra Cyber P.S. Case No. 245 of 2024) alleging offences under Sections 318(4), 328, 336(3) of the B.N.S. and Sections 66(C) and 66(D) of the Information Technology Act. The prosecution alleged that a fake Facebook ID of the S.P., Saran was created and that victims were cheated of Rs.20,000 and Rs.40,000. The petitioner contended he was falsely implicated, pointing out that a co‑accused’s confessional statement named another person as the SIM seller and that the mobile numbers in the FIR did not belong to him; he also had no prior criminal record and had been in custody since 23‑09‑2025. The State opposed bail. After hearing both sides, the Court found the evidence insufficient to deny bail and ordered the petitioner to be released on a bail bond of Rs.10,000 with two sureties of equal amount. The bail order was directed to be filed before the Magistrate of Saran.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious cyber‑offences alleged under the B.N.S. and IT Act.
  • Whether the confessional statements of co‑accused and lack of direct evidence against the petitioner justify granting bail.
