Holding
Bail is granted to the petitioner.
Summary
The petitioner, Subodh Singh, was arrested in connection with a murder case (Barbigha P.S. Case No. 96 of 2004) under Sections 302, 201 and 34 of the Indian Penal Code. The prosecution alleges that Surendra Singh was killed by the accused, including the petitioner. The petitioner’s counsel argued that co‑accused Mantu Kumar and Chhote Ram had already been granted bail and contended that the death was accidental, not murder. The court considered the bail applications of the co‑accused and the petitioner’s claim of accidental death. Finding no substantive reason to deny bail, the court ordered the petitioner’s release on a bail bond of Rs.10,000 with two sureties, subject to his cooperation in the trial.
Issues considered
- Whether bail should be granted to the petitioner charged with murder and related offences under Sections 302, 201 and 34 of the IPC, considering that co‑accused have been released on bail and the claim of accidental death.
