Patna High Court

Raja BadhayeeversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to a bond and conditions under the BNSS, 2023.

Summary

Petitioner Raja Badhayee was arrested in connection with B.K.P. P.S. Case No. 294 of 2025 for alleged assault with a lathi‑danda and iron rod, and for allegedly snatching Rs.40,000 and a mangalsutra. The petitioner claimed innocence, stating that the incident was a dispute over wall removal with the informant, who is a neighbour, and that a counter‑case (Case No. 305 of 2025) had also been filed. The petitioner’s counsel sought permission to correct a clerical error regarding the relationship of parties and then applied for anticipatory bail, emphasizing the petitioner’s clean criminal record. The State opposed bail, but the court, after hearing both sides, granted anticipatory bail subject to a bond of Rs.30,000 and conditions under Sections 2(1)(d) and 482(2) of the BNSS, 2023. The order was pronounced by Justice Dr. Anshuman.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the BNSS, 2023 despite the serious offences alleged.
  • Whether the petitioner’s clean antecedent and the existence of a counter‑case justify granting bail.
