The Court denied bail to the petitioner.
Summary
Gopal Pandit was arrested in connection with a narcotics case where 1.25 kg of heroin was seized, and he was charged under Sections 8(c), 21(c), 22(B), 25 and 29 of the NDPS Act. The petitioner applied for regular bail, asserting that he was falsely implicated, that no narcotic material was recovered from his possession, and that he has no prior criminal record. The State, represented by the Narcotics Control Bureau, opposed the bail on the ground of the large quantity of heroin involved. The Court examined the seriousness of the offence and the magnitude of the seizure. Considering the substantial recovery, the Court was not inclined to grant bail and dismissed the bail application.
