BAIL GRANTED

Holding

The application for bail was allowed, directing release of the petitioners on bail with conditions.

Summary

The petitioners, a group of women residing in Samhuta Tarkulwa Dera, Buxar, filed an application fearing arrest in connection with a criminal case (Dhansoi P.S. Case No. 131 of 2025) that alleged offences under several sections of the Indian Penal Code. The prosecution alleged that the petitioners, along with others, had assaulted the victim. The petitioners contended that they were falsely implicated and that the allegations were general and omnibus. The learned counsel argued that the petitioners, being women, should be granted bail to prevent undue hardship. The High Court, after hearing both sides, allowed the application, directing that the petitioners be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the conditions of Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether the petitioners are entitled to bail in view of the alleged offences.
  • Whether the petitioners have been falsely implicated and thus merit anticipatory bail.
  • Whether Section 438(2) CrPC and Section 482 BNSS can be invoked to grant bail.
