DISMISSED

Holding

The court held that the case is not a fit one for grant of anticipatory bail and dismissed the application.

Summary

The petitioner, Sanni Kumar, sought anticipatory bail in connection with a criminal case (PS Case No. 389 of 2024) involving alleged offences of rape, murder and conspiracy under Sections 376, 302 and 201/34 of the IPC. During the hearing, the Investigating Officer claimed she had taken charge after leave but the charge was not recorded by the SHO, leading to her suspension for not producing the case diary. The court examined the prosecution's claim that the deceased's body had been recovered and that the petitioner was implicated. Considering the seriousness of the offences and the procedural irregularities, the court concluded that the matter was not suitable for anticipatory bail. Consequently, the anticipatory bail application was dismissed, with a direction that if the petitioner surrenders within six weeks, a regular bail application may be considered.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case involving alleged rape, murder and conspiracy.
  • Whether the non‑production of the case diary and the suspension of the Investigating Officer affect the grant of anticipatory bail.
