Decided
Disposal
BAIL GRANTED

Holding

In the absence of any material linking the petitioner to the alleged murder, anticipatory bail under Section 438 CrPC may be granted.

Summary

The petitioner, Sanjeet Kumar, sought anticipatory bail in a murder case (Section 302/34 IPC) where his name does not appear in the FIR but was mentioned during investigation. The prosecution alleged that the informant's son was killed by co‑accused Kalu/Amit Kumar and his associates. The court noted that no material evidence had been collected against the petitioner to show his complicity. Two similarly situated co‑accused had already been granted anticipatory bail. Considering the lack of incriminating material and the statutory provisions, the court ordered that the petitioner be released on anticipatory bail upon furnishing a bail bond and sureties, subject to conditions under Section 438(2) CrPC and Section 482(2) B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Criminal Procedure Code.
  • Whether the petitioner’s alleged involvement, as inferred from investigation statements, suffices to deny bail.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are applicable.

later, his dead-body was found with bruises. Informant believes

                   associates.
