Patna High Court

Rahul PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to all petitioners, subject to a bond and sureties under Section 480(3) of the BNSS.

Summary

The Patna High Court considered bail applications filed by four accused persons—Mantu Kumar, Rahul Paswan, Raju Kumar and Anchal Kumar—who were arrested in connection with a Giriyak police case alleging cyber fraud and related offences under the Bharatiya Nyaya Sanhita, 2023 and the Information Technology Act. The petitioners argued that the search of their residence was not conducted in accordance with Section 103(4) of the BNSS and that only one mobile phone was seized from them, while other phones recovered belonged to other family members. The State opposed bail, contending the seriousness of the offences listed, including sections 66(C) and 66(D) of the I.T. Act. The Court noted that the petitioners had been in custody since 30 July 2025, that the investigation was complete, and that there was no risk of tampering with evidence. Relying on the provisions of Section 480(3) of the BNSS, the Court held that bail could be granted subject to a bond and sureties. Accordingly, each petitioner was ordered to be released on bail upon furnishing a Rs.10,000 bond with two sureties of equal amount.

Issues considered

  • Whether the alleged procedural irregularities in the search under Section 103(4) of the BNSS warrant denial of bail
  • Whether the nature of the offences under the BNSS and the I.T. Act justifies continued detention
  • Whether the petitioners pose a risk of tampering with evidence or fleeing
