Rinku YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, directing him to furnish a bail bond of Rs. 10,000 with two sureties and comply with stipulated conditions.

Summary

The petitioner, Rinku Yadav, applied for regular bail in a case registered under Section 395 of the Indian Penal Code for an alleged robbery where five miscreants allegedly robbed an informant of Rs. 8,000 and valuables. The petitioner claims innocence, stating that no incriminating material was recovered from him and that his alleged involvement surfaced only from the confessional statement of co-accused Umesh Yadav. No tip‑off investigation (TIP) was conducted, and the petitioner has been in custody since 9 September 2025, while other co‑accused have already been granted bail. The learned counsel argued that the petitioner was falsely implicated and that the evidence against him is insufficient. Considering these facts, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation and availability for trial.

Issues considered

  • Whether a person accused of an offence under Section 395 IPC, a non‑bailable offence, is entitled to regular bail in the absence of material evidence and when other co‑accused have been granted bail.
