The court confirmed the provisional bail, effectively granting regular bail to the petitioner while keeping the same bail bonds.
Summary
Krishna Yadav petitioned for regular bail in a complaint case involving serious offences under Sections 498A, 323, 504, 406, 120B, 379, 409 of the IPC and Section 27 of the Arms Act. The petitioner's brother‑in‑law, Rekha Devi (Opposite Party No.2), alleged that he had tortured her and contested a partition of property, refusing to sign the panchnama that showed her one‑third share being separated. The court considered the panchnama and the fact that the partition dispute was a civil matter, not directly related to the criminal charges. It confirmed the provisional bail previously granted, ordering the petitioner to remain on the same bail bonds. The court advised that if the opposite party is dissatisfied with the panchnama, she may file a partition suit, and clarified that its observations were prima facie and would not affect the trial.
Issues considered
- Whether regular bail can be granted to the petitioner despite the gravity of the offences alleged.
- Whether the existence of a partition dispute and the panchnama affect the grant of bail.
