Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Petitioner Rakesh Kumar Singh sought anticipatory bail fearing arrest in a case involving the seizure of 2,200 litres of illicit liquor under Sections 30(a), 34 and 36 of the Bihar Prohibition and Excise Act. The prosecution alleged his involvement, while the petitioner claimed innocence and highlighted a donation of Rs. 2 lakh to Ramakrishna Math as evidence of good character. The court examined the merits of the application and the relevant statutory provisions. It allowed the anticipatory bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to appear at the police station every Sunday. Non‑appearance would lead to cancellation of the bail.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS in the pending case under the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed, including regular police‑station attendance, are appropriate.
