Patna High Court

Jagdish JoshiversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was not granted.

Summary

The petitioner, Jagdish Joshi, owner of a truck, was implicated in a case where 2833.200 litres of illicit liquor were recovered hidden under the driver’s seat. He filed an anticipatory bail application fearing arrest under sections 30(a), 41(i) and 32(3) of the Bihar Prohibition and Excise Act, 2022. The Patna High Court examined the facts, noting the large quantity of liquor seized and the petitioner’s ownership of the vehicle. The Court held that these circumstances did not merit the grant of anticipatory bail. Accordingly, the application was dismissed and the petitioner was directed to surrender within two weeks to apply for regular bail, failing which the police may arrest him.
