Decided

BAIL GRANTED

Holding

Bail was granted to the petitioner as the death was held to be a suicide.

Summary

The petitioner, Bihari Choudhary, applied for bail in a case registered under Section 80(2), 238 and 3(5) of the BNS for the alleged killing of his wife. The prosecution alleged murder, but the material on record indicated that the couple had a fight after which the wife committed suicide. The petitioner had been in custody since 4 April 2025. The court examined the facts and concluded that the death was a suicide, not a homicide. Consequently, the bail application was allowed, subject to a bail bond of Rs.10,000 with two sureties of the same amount.
