Patna High Court

Deepak KumarversusThe State of Bihar

Decided

Holding

The lower court must accept the bail bond and release the petitioner as per the High Court's earlier bail order.

Summary

The petitioner, Deepak Kumar, had earlier been granted bail by the High Court on 22 September 2025 in connection with Beur Police Station Case No. 134/2025. However, the lower court refused to accept his bail bond, citing a prior criminal antecedent, and the petitioner remained in custody since 17 July 2025. The petitioner’s counsel argued that the bail order of this Court should be complied with despite the antecedent. The State opposed, maintaining that the antecedent justified denial of bail. The Court held that the lower court must honor the earlier bail order and accept the bail bond, directing the petitioner’s release.
