Patna High Court

Ranjan kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Ranjan Kumar, sought anticipatory bail fearing arrest in a dowry harassment case (Mahila P.S. Case No. 73 of 2025) where he was charged under several sections of the Bihar Negotiable Sale Act and Section ¾ of the Dowry Prohibition Act. The prosecution alleged that he assaulted the victim to demand dowry, while the petitioner claimed he was falsely implicated. The State opposed the bail application. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, the High Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to pay maintenance of Rs.10,000 to his wife. The order was made subject to the conditions of Section 438(2) of the CrPC and Section 482 of the Bihar Negotiable Sale Act.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in view of the allegations.
  • Whether the principles laid down in Arnesh Kumar v. State of Bihar are applicable to this case.
  • Whether the conditions imposed (bail bond, sureties, maintenance) are appropriate.
