Holding

The petitioner is entitled to bail and should be released upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Md. Astak Ahmad, was arrested in connection with a robbery (Section 392 IPC) after a bag containing cash and documents was stolen. The FIR named unknown miscreants, but during investigation a co-accused, Mantajir Alam, gave a confessional statement that implicated the petitioner, although no incriminating material was recovered from him. The petitioner contended that he was falsely implicated and highlighted that other co-accused had already been granted bail. The State opposed bail, arguing the seriousness of the offence and the confessional statement. After hearing both sides, the High Court found the circumstances comparable to the other co-accused and ordered the petitioner to be released on bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail under Section 392 IPC despite a co-accused’s confessional statement.
  • Whether the absence of recovered material and the grant of bail to other co-accused justify releasing the petitioner.
  • Whether the seriousness of the alleged robbery warrants continued detention.
