Holding

The application for interim protection is dismissed for non‑prosecution and the interim order is withdrawn.

Summary

The petitioner, Rajveer Kumar, feared arrest in a dowry harassment case (Complaint No. 526C of 2023) filed under Section 498A of the IPC and Section 4 of the Dowry Prohibition Act. The matter had been referred to mediation, but neither the petitioner nor his counsel participated. The petitioner sought interim protection from the High Court, claiming the mediation process was being used to delay proceedings. The State, represented by Mr. Pronoti Singh, argued that the petitioner was merely attempting to stall the trial. The Court observed the petitioner’s non‑appearance and lack of cooperation, and consequently dismissed the application for interim relief on the ground of non‑prosecution. The interim order dated 17.01.2026 was withdrawn, and the trial was directed to proceed on a day‑to‑day basis with a status report to be filed after three months.

Issues considered

  • Whether the petitioner's application for interim protection should be entertained despite his non‑appearance and non‑cooperation in mediation
