The Court granted provisional bail to each petitioner conditioned on payment of Rs.5 lakh within the specified period (four months for Rajesh Kumar, three months for Anil Kumar) and authorized cancellation of bail if the payments are not made.

Summary

The High Court heard two related criminal miscellaneous applications arising from Complaint Case No. 865 of 2023, wherein the complainant alleged that petitioners Rajesh Kumar and Anil Kumar, partners in a real‑estate project, received Rs.10 lakh for a duplex but failed to deliver the premises or refund the money. The petitioners sought bail, offering to repay Rs.5 lakh each to the complainant in instalments. The Court, recalling its earlier order directing payment of Rs.5 lakh each, entertained the petitioners' request for a specific time‑frame to complete the payments. It ordered Rajesh Kumar to pay the amount in four months and Anil Kumar in three months, with provisional bail to be released upon the first instalment and subject to cancellation if payments are not made. Failure to comply would lead to cancellation of the bail bonds, while full payment within the stipulated period would confirm the bail.

Issues considered

  • Whether provisional bail can be granted subject to a monetary payment to the complainant
  • Whether the Court can prescribe a specific time‑frame for the payment of the compensation
  • Whether coercive steps against the petitioners can be stayed pending payment
