BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specific conditions.

Summary

Arun Kumar was arrested on 28 July 2025 in connection with a case involving alleged possession of a loaded and an unloaded country‑made Katta, a cartridge and Rs.25,000 cash, charged under Sections 25(1‑b)a, 26 and 3(5) of the Bharatiya Nyay Sanhita, 2023. He applied for bail, claiming innocence and alleging non‑compliance with Section 103 of the BNSS regarding the search of his house. The prosecution opposed bail, highlighting six prior criminal antecedents, though noting the petitioner was already on bail in three other cases. The court examined the nature of the offences, the procedural lapse alleged, and the petitioner’s criminal history. It granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of court attendance, non‑tampering with evidence or witnesses, and verification of any concealed antecedents.

Issues considered

  • Whether bail should be granted despite the seriousness of the offences under the Bharatiya Nyay Sanhita.
  • Whether the alleged non‑compliance with Section 103 of the BNSS affects the grant of bail.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
