Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner with conditions of a bail bond, sureties, and monthly payment of Rs.5,000 to the complainant.

Summary

The petitioner, Dilwar Hussain, was implicated in a dowry harassment complaint (Sherghati Complaint Case No. 142/2023) alleging physical and mental torture, attempted murder, and demand for dowry under Sections 323, 324, 379, 498A of the IPC and Section 4 of the Dowry Prohibition Act. The petitioner denied any wrongdoing and offered to pay Rs.5,000 per month as living expenses to the complainant, an offer which the complainant accepted. The court considered the petitioner's willingness to provide financial support and the acceptance of the offer as a factor to maintain family harmony. Consequently, the court granted anticipatory bail to the petitioner, subject to a bail bond of Rs.10,000 and two sureties, and imposed the condition that he deposit Rs.5,000 monthly in the complainant’s bank account. The order also invoked Section 482(2) of the Criminal Procedure Code to exercise inherent powers of the court.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner in a dowry harassment case?
  • Whether the petitioner’s offer to pay a monthly sum to the complainant influences the grant of anticipatory bail?
