Patna High Court

Subodh YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner.

Summary

Petitioner Subodh Yadav, brother‑in‑law of the alleged victim, was arrested in connection with a case registered under Sections 366 and 34 of the Indian Penal Code. The victim had recorded a statement under Sections 180 and 183 of the BNSS, in which she did not support the prosecution’s allegations. The petitioner, represented by Mrs. Rabia Gulnaz, pleaded for regular bail, emphasizing his clean antecedent, the fact that he had been in custody since 19‑08‑2024, and that his trial was unlikely to conclude soon. The State, through APP Mr. Anand Kishore Choudhary, opposed the bail. Considering the victim’s non‑supportive statement, the petitioner’s clean record and the completed investigation, the Court granted bail on a bond of Rs. 20,000 with two sureties of equal amount.
