Holding
Anticipatory bail was denied because the nature of the injury and the seriousness of the offences did not justify its grant.
Summary
Ramji Yadav, the petitioner, feared his arrest in connection with FIR No. 288/2023 filed at Rafiganj Police Station, which alleged that he assaulted the husband of an informant with a garasa, causing grievous injuries as certified by a doctor. The FIR charges him under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code. He applied for anticipatory bail to avoid detention pending trial. The learned counsel for the State opposed the bail, emphasizing the seriousness of the alleged offences and the nature of the injury. Justice Prabhat Kumar Singh, after hearing both sides, held that the seriousness of the injury warranted denial of anticipatory bail. Consequently, the petition for anticipatory bail was dismissed.
