Patna High Court

Robin Yadav @ Rabeen YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no sufficient basis to deny his release.

Summary

The petitioner, Robin Yadav, was charged under multiple sections of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act for alleged participation in a shooting, assault, kidnapping and the subsequent death of an informant's son. He contended that the FIR only implicated other co‑accused in the assault and kidnapping and that he was merely present at the scene, with no overt act attributed to him. The State opposed bail, arguing the seriousness of the offences. The court noted that a co‑accused, Satish Yadav, had previously been granted bail and considered the length of the petitioner's custody since June 2025. Accordingly, the court ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • Whether the petitioner, who is alleged only to have been present at the scene, is entitled to bail despite the serious nature of the charges under the B.N.S., 2023 and the Arms Act.
