The Court granted bail to the petitioner, directing a bond of Rs 10,000 with two sureties and specific attendance conditions.
Summary
The petitioner, Suraj Paswan, was arrested in connection with a robbery case (Panchanpur P.S. Case No. 52 of 2025) alleged under Sections 331(4) and 305 of the B.N.S. The prosecution’s case rests solely on the confessional statements of a co‑accused, with no material recovered from the petitioner’s possession. The petitioner contended that he was falsely implicated and that, apart from the confessional statements, there is no evidence against him. The State opposed bail, highlighting the petitioner’s antecedent of eleven criminal cases. After hearing both sides, the Court considered the lack of substantive evidence and the petitioner’s right to liberty, and ordered that bail be granted on a bond of Rs 10,000 with two sureties and conditions of regular attendance at the trial and weekly reporting to Tekari Police Station. The order emphasizes cooperation with the trial and compliance with the stipulated conditions.
Issues considered
- Whether bail should be granted to the petitioner when the prosecution’s case is based only on a co‑accused’s confessional statement and the petitioner has multiple prior criminal cases.
