Holding

Bail was granted to the petitioner.

Summary

Kishundev Ram was arrested in connection with a murder case (Baruraj P.S. Case No. 188 of 2024) under Sections 115(2), 126, 80 and 3(5) of the BNS. He had been in custody since 15 January 2025 and claimed he was falsely implicated and that the trial was unduly delayed. The petitioner’s counsel argued that the prolonged detention violated his right to a speedy trial. The court considered the length of custody and the delay in the trial as sufficient grounds to grant bail. Accordingly, the court ordered his release on bail with a bond of Rs. 10,000 and two sureties, subject to his cooperation with the trial proceedings.
