The court granted regular bail to the petitioner.

Summary

Ravi Kumar was arrested in connection with a theft case (PS Case No. 186 of 2025) and charged under sections 334(1) and 303(2) of the Bihar Negotiable Instruments Act. The prosecution alleged that mobiles and other articles were stolen from the informant's shop and that a confessional statement by the petitioner led to the recovery of certain items from his house, although those items were not placed on the theft‑in‑information (TI) parade and were claimed to be his own. The petitioner, represented by Mr. Dharmveer, argued that he is innocent, has been in judicial custody since 16‑10‑2025, and that the recovered articles are not the stolen property. The State, through APP Mr. Nirmal Kumar Sinha, opposed bail, citing three prior criminal convictions. After hearing both sides, the court decided to grant regular bail on a bond of Rs.10,000 with two sureties, directing the petitioner to appear before the Judicial Magistrate of Gopalganj.

Issues considered

  • Whether the petitioner is entitled to regular bail despite a confessional statement and alleged criminal antecedents
  • Whether the items recovered from the petitioner’s house constitute the stolen property alleged in the charge
