Patna High Court

Manikant SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions imposed.

Summary

Manikant Singh sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 118(2), 109, 352 and 3(5) of the Indian Penal Code. The prosecution alleged that Singh, while holding a farsa, struck an informant on the head causing severe injury during a land‑related altercation. Singh contended that the dispute was a mutual fight over land rights, both parties sustained only simple injuries, and he committed no offence. The State opposed the bail, arguing the seriousness of the alleged offences. The Court, after considering the nature of the injuries and the case‑and‑counter‑case scenario, granted anticipatory bail subject to a bail bond of Rs.10,000, two sureties of the same amount, and conditions under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious nature of the alleged offences
  • Whether the facts disclosed justify the exercise of the Court’s power under Section 482(2) of the Criminal Procedure Code to release the petitioner on bail
