Patna High Court

Ranjit Kumar @ Ranjit YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bail bond of Rs 10,000 each with two sureties and conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioners, Ranjit Kumar and Pawan Kumar, filed a bail application fearing arrest in a case registered under several offences of the Bhartiya Nyaya Sanhita arising from an alleged assault on an informant and his family during a land dispute. The FIR dated 28‑02‑2025 alleges that the petitioners, along with other accused, entered the informant’s house, abused the occupants and assaulted them, causing injuries to both parties. The petitioners contended that the charge sheet contains only a general and omnibus allegation without any specific accusation of an overt act against them and highlighted their clean antecedent. The State opposed the bail, arguing the seriousness of the offences. The Court examined the nature of the allegations, the lack of specific incriminating material against the petitioners, and the principle of liberty under bail law. Accordingly, the Court ordered that the petitioners be released on bail upon furnishing a bail bond of Rs 10,000 each with two sureties, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered

  • Whether the petitioners are entitled to bail despite the serious nature of the offences alleged in the FIR.
  • Whether the charge sheet contains specific allegations of overt acts against the petitioners sufficient to deny bail.
  • Whether the petitioners’ clean antecedent and the nature of the land‑dispute context justify the grant of bail.
