Patna High Court

Manager Singh @ Mainejar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to a bail bond and conditions under Section 482(2) CrPC.

Summary

The petitioner, Manager Singh, sought anticipatory bail in a criminal complaint alleging offences under IPC sections 354A, 498A, 504 and 506 relating to alleged dowry harassment. The prosecution alleged that the petitioner, along with co‑accused, tortured the complainant for dowry demands. The petitioner contended he was innocent, a father‑in‑law with no involvement in the family dispute, and that the primary accused, the complainant's husband, had already been granted anticipatory bail. The State opposed the bail application. The Court, noting the prior grant of anticipatory bail to the husband and the lack of direct involvement of the petitioner, allowed anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the CrPC.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite allegations under Sections 354A, 498A, 504 and 506 of the IPC.
  • Whether the grant of anticipatory bail to the complainant's husband influences the petitioner's bail application.
  • Whether the conditions prescribed under Section 482(2) of the Criminal Procedure Code are satisfied.
