Patna High Court

Deepak YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to conditions under Section 438(2) of the Code of Criminal Procedure.

Summary

The petitioner, Deepak Yadav, was arrested in connection with a case alleging illegal parking under Sections 308(2), 308(3) and 3(5) of the Bihar Nagarik Suraksha Act, 2023. He contended that he held a valid licence from the Gaya Municipal Corporation to operate a parking at Salempur Ghat and that the FIR was filed four days after the alleged incident without any explanation. The prosecution opposed bail, citing the alleged illegal collection of parking charges and two prior criminal antecedents, though the petitioner was already on bail in those matters. The Court examined the licence, the delay in filing the FIR, and the petitioner’s criminal record, and concluded that bail could be granted subject to strict conditions. Accordingly, the Court ordered bail on a bond of Rs.10,000 with two sureties, invoking Section 438(2) of the CrPC and imposing conditions of cooperation, appearance, and non‑tampering with evidence.

Issues considered

  • The petitioner’s entitlement to bail despite allegations of illegal parking and prior criminal antecedents.
  • Whether the delay of four days in filing the FIR affects the grant of bail.
  • Whether holding a municipal licence negates the alleged offence under the Bihar Nagarik Suraksha Act.
