Md. Muzaffar @ Md. Mujaffar @ MuzaffarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioner is entitled to regular bail on the condition of furnishing the prescribed bail bond and sureties.

Summary

The petitioner, Md. Muzaffar, was arrested in connection with a kidnapping case (Rauta PS Case No. 264/2025) involving offences under Sections 137(2), 96, 64 and 3(5) of the Bihar Narcotic Substances Act and Section 4 of the POCSO Act. The petitioner claimed innocence, arguing that the alleged victim had eloped with him and that he had a clean antecedent, having been in custody since 1 November 2025. The State and the informant opposed the bail application, contending that the charges were serious. The Court examined the facts, the victim’s statement, and the petitioner’s willingness to cooperate with the trial. Considering the circumstances, the Court allowed the regular bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the Bihar Narcotic Substances Act and the POCSO Act
