Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to conditions prescribed under Section 482(2) of the Code of Criminal Procedure.

Summary

Munilal Mahto was arrested in connection with a case alleging that he placed his hand on a woman's breast, offences charged under Sections 74 and 76 of the B.N.S. The petitioner claimed a clean antecedent and argued that he was falsely implicated due to a family dispute involving the informant's daughter and his brother‑in‑law. The prosecution opposed bail, emphasizing the seriousness of the allegations. The Court, noting the petitioner's clean record and the possibility of false implication, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the CrPC. The bail order required the petitioner to cooperate with the trial, appear in court as directed, and prohibited tampering with evidence or witnesses, with provisions for cancellation if conditions were breached.

Issues considered

  • Whether bail should be granted to the accused in a case involving alleged sexual assault under Sections 74 and 76 of the B.N.S.
  • Whether the petitioner's clean antecedent and claim of false implication justify bail despite the seriousness of the allegations.

          is levelled against the petitioner.

                       6. Considering the aforesaid facts and circumstances

that petitioner has clean antecedent and due to some family
