The court granted regular bail to the petitioner.

Summary

The petitioner, Akshay Kumar, sought regular bail in a case registered under sections 120B, 302 and 34 of the Indian Penal Code for the alleged murder of his son Pankaj Kumar. The prosecution’s case was based largely on the informant’s suspicion that the petitioner was one of seventeen persons involved in the crime, with no direct evidence presented. The petitioner’s counsel argued that the allegation was vague, the petitioner had no criminal antecedent, and other co‑accused had already been granted bail in similar cases. The State opposed the bail, contending the seriousness of the offences. After considering the lack of concrete evidence, the petitioner’s clean record, and the precedent of bail to co‑accused, the court decided to grant bail. The petitioner was ordered to be released on a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under sections 120B, 302 and 34 IPC.
  • Whether the informant’s suspicion alone suffices to deny bail.

When the informant went there along with his family members,

he found the body of his son, namely, Pankaj Kumar. In the last

part of the FIR, the informant has stated that he believes that

allegation is general and omnibus. It is only the suspicion of the

informant on which, the petitioner has been named in this case.

A statement has been made in para-3 of this petition that the

petitioner has got no criminal antecedent. It has further been

                       5. Learned APP appearing for the State has

vehemently opposed the prayer of regular bail.

                       6. Having heard learned counsel for the parties and
