Holding
The Court granted regular bail to the petitioner, holding that his age, completed investigation and educational interests justified release on bail.
Summary
The petitioner, an 18‑year‑10‑month‑old student, was arrested in connection with offences under Sections 334(1) and 303(2) of the Bharatiya Nyaya Sanhita, 2023, and has been in custody since 14 October 2025. He filed a regular bail petition, arguing that his young age, impending board examinations, lack of prior criminal record, and the fact that the prosecution’s case rests mainly on a confessional statement of doubtful evidentiary value warrant his release. The State opposed the bail on the ground of the seriousness of the charges. The Court, noting the petitioner’s age, the completion of the investigation, and the potential irreparable harm to his education, decided to grant bail. The order directed the petitioner to furnish a bail bond of Rs 20,000 with two sureties of the same amount.
Issues considered
- Whether bail should be granted to an accused who is a minor‑aged adult (under 19) pending trial for offences under Sections 334(1) and 303(2) of the Bharatiya Nyaya Sanhita.
- Whether a confessional statement, lacking corroboration, can be the sole basis for continued detention.
- Whether the completion of investigation and the petitioner’s educational considerations outweigh the nature of the alleged offences.
